ASSUMPTION OF RISK & WAIVER OF LIABILITY AGREEMENT
IN CONSIDERATION of allowing me to participate in the program, related events and activities (the Activity) of Haliburton Forest & Wild Life Reserve Limited (the Company), I warrant to you that:
(1) I am aware that there are serious dangers and risks inherent to any Activity in a Forest, (2) I accept all the inherent risks in my chosen Activity and the possibility of personal injury, death, contracting of an infectious disease, property damage or loss resulting from that Activity, (3) I believe that I am physically, emotionally and mentally able to participate in this Activity, and that my personal equipment is mechanically fit for my participation in this Activity, (4) I understand that all applicable rules for participation must be followed and that at all times the sole responsibility for personal safety remains with me, and (5) I will immediately remove myself from participation, and notify the nearest official or staff, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that I have experienced any deterioration in my physical, emotional or mental fitness.
I UNDERSTAND AND AGREE, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, that my participation in this Activity and execution of this document constitutes:
(1) An unqualified ASSUMPTION OF ALL RISKS associated with participation in this Activity, even if there is harm arising from negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of the Activity organizer and any persons associated therewith or participating therein, (2) a full and final RELEASE AND WAIVER OF LIABILITY of the Company and all persons and organizations associated with it, including, without limiting the generality of the foregoing, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/or lessors of the premises used to conduct the Activity, sanctioning bodies, medical or rescue personnel, of and from with the respect to all injury, disability, death or loss, whether arising from the negligence of or by the foregoing or otherwise, (3) an UNDERSTANDING NOT TO SUE the Company for any loss, injury, damages of any form, howsoever caused, and whether directly or indirectly from the participation in this program by me, and (4) an AGREEMENT TO INDEMNIFY, and to save and hold harmless the Company, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence of the Company or otherwise.
I HAVE READ THIS DOCUMENT THOROUGHLY. I UNDERSTAND THAT THE COMPANY IS RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER, AND AGREEMENTS WHEN ACCEPTING MY PARTICIPATION IN THIS ACTIVITY. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I GIVE UP SUBSTANTIAL LEGAL RIGHTS I WOULD OTHERWISE HAVE. I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.

you are aware of that may affect your health during the Canopy Tour.
Conditions & Rules
- No person is permitted to enter the range area without consent or without being accompanied by an authorized member of Haliburton Forest staff.
- Range personnel will solely consist of Haliburton Forest staff who have been trained in the safety rules and operating procedures of the range. Trained and authorized Haliburton Forest staff shall be the appointed Range Officer (RO) when the range is in use. The RO has full control and final word over all range activities.
- No one under the influence of alcohol or drugs is permitted within shooting range perimeter.
- No open toe shoes are allowed.
- Ear and eye protection should be worn while shooting.
- Any client using their own firearm should ensure that it is unloaded, locked and in a case on arrival at Haliburton Forest and remain so until directed otherwise by the Range Officer.
- Follow the A.C.T.S & P.R.O.V.E procedures.
- An order in which the clients shoot will be determined before commencing any shooting.
- Firearms must always be controlled. Never point a firearm at a person.
- Firearms shall be pointed down range when being loaded.
- Unloaded firearms must be placed in a gun rack at the shooting station with the action open.
- Loaded firearms must not be passed from one person to another.
- Only one client at a time shall handle or shoot a firearm under the direct supervision of the RO.
- While a client is shooting, no one else shall handle a firearm.
- No one shall approach a shooting client while they are preparing to load the firearm, positioning to fire the firearm or when firing is in progress.
- Firing is only permitted when the RO calls “Commence fire”.
- No person shall cross the firing line.
- Adult spectators and children are the responsibility of the shooting clients who they came with and must always remain under the shooting client’s control.
- All shells must be cleaned up after use and placed in the containers provided.
- No shooting of wildlife is permitted.
I, as the parent or guardian of the youth listed above have read and understand the above conditions and rules, agree to be bound by the terms, and ensure the youth I am responsible for will comply with them. I understand that failure to follow them or any of the Range Officer’s instructions may result in expulsion from the experience without refund.
